1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “customer”) and Safe Water Iowa, LLC, an Iowa limited liability company (“Safe Water Iowa,” “we,” “our,” or “us”). By accessing or using our website at safewateriowa.com, purchasing any product from us (whether online, at a vendor fair, community event, or through any other channel), opting in to receive SMS/text messages, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, available at safewateriowa.com/privacy-policy.
If you do not agree to these Terms, you must not use our website, purchase our products, or opt in to our text messaging program. We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website with an updated “Effective Date.” Your continued use of our website or services after any such modification constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement to use our website, purchase our products, or opt in to receive SMS/text messages. By placing an order or opting in to our text messaging program, you represent and warrant that you are at least 18 years old and meet these requirements.
3. Products and Product Descriptions
3.1 Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, and pricing on our website are accurate and current. However, we do not warrant that product descriptions or other content on our website are error-free, complete, or current. Product colors, dimensions, and features may vary slightly from what is displayed on screen due to monitor settings, photography, or minor manufacturing variations.
3.2 Product Use
Our water filtration products, including reverse osmosis systems, replacement filters, and related accessories, are designed for residential household use in accordance with the manufacturer’s specifications and installation instructions. You are solely responsible for ensuring that any product you purchase is suitable for your specific water supply, plumbing configuration, and intended use.
3.3 Installation
Our products are designed for do-it-yourself (DIY) installation using quick-connect fittings. Installation instructions and/or video guides are included with each system. Safe Water Iowa does not provide professional installation services. If you choose to hire a third-party plumber, handyman, or other professional to install your system, that individual or company is not an agent, contractor, or employee of Safe Water Iowa, and we bear no responsibility or liability for their work, any damage resulting from their installation, or any claims arising from their services.
4. Orders, Pricing, and Payment
4.1 Order Acceptance
All orders placed through our website, at vendor fairs, or through any other sales channel are subject to acceptance by Safe Water Iowa. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to: product availability, errors in product or pricing information, suspected fraud, or other issues identified by our payment processor. If we cancel an order after payment has been collected, we will issue a full refund.
4.2 Pricing
All prices displayed on our website are in U.S. dollars. Prices are subject to change without notice. Promotional pricing, including Friends & Family legacy pricing, is available only during the applicable promotional period and subject to the specific terms communicated with each promotion. Applicable sales tax will be added at checkout in accordance with Iowa state and local tax requirements.
4.3 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By submitting payment, you agree to Stripe’s terms of service. We do not store your credit card or payment card information on our servers. Safe Water Iowa is not responsible for any errors, delays, or issues caused by the payment processor.
4.4 Pre-Sale Deposits
From time to time, Safe Water Iowa may offer pre-sale opportunities requiring a refundable deposit to reserve a product at a promotional price. Pre-sale deposits are subject to the specific terms communicated at the time of the promotion, including deposit amounts, deadlines, balance-due timing, and refund conditions. If Safe Water Iowa is unable to fulfill a pre-sale order for any reason, the full deposit will be refunded. Deposits are refundable upon request at any time prior to shipment of the product. Once the balance is paid and the product has shipped, the transaction is governed by the return policy set forth in Section 5.
5. Shipping, Returns, and Refunds
5.1 Shipping
We ship to addresses within the United States. Shipping costs, if any, will be displayed at the time of purchase. Free shipping promotions may be offered at our discretion and are subject to change. Estimated delivery times are provided for convenience and are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier. Safe Water Iowa is not responsible for delays, loss, or damage caused by the shipping carrier after the product has been tendered for shipment. Shipping insurance may be included at our discretion.
5.2 Returns
You may return a product within thirty (30) days of delivery, subject to the following conditions:
(a) Condition: The product must be in its original, unopened, and unused condition with all original packaging, accessories, and documentation. Products that have been installed, used, connected to a water supply, or are missing components are not eligible for return.
(b) Process: To initiate a return, you must contact us at [email protected] within the 30-day return window. We will provide return instructions, including a return authorization number. Products returned without prior authorization may be refused.
(c) Return Shipping: You are responsible for all return shipping costs. We recommend using a trackable shipping method and purchasing shipping insurance, as we cannot be responsible for products lost or damaged in return transit.
(d) Replacement Filters and Accessories: Replacement filters, filter cartridges, and accessories are non-returnable once opened, for hygiene and safety reasons.
5.3 Refunds
Upon receipt and inspection of your returned product, we will process a refund to your original method of payment within ten (10) business days. Refunds will be for the purchase price of the product only; original shipping charges (if any) are non-refundable. If a returned product does not meet the return conditions described above, we reserve the right to decline the return and ship the product back to you at your expense.
5.4 Defective Products
If you receive a product that is defective, damaged during shipping, or materially different from what was described, please contact us at [email protected] within seven (7) days of delivery. We will, at our option, replace the product or issue a full refund, including any shipping costs incurred. We may request photographs or other documentation of the defect or damage.
6. SMS/Text Message Terms
6.1 Program Description and SMS Use Cases
Safe Water Iowa offers an optional SMS/text messaging program to keep customers informed and supported. By opting in, you may receive text messages related to the following:
(a) Transactional Messages: Order confirmations, payment receipts, shipping notifications, delivery updates, and tracking information.
(b) Service Messages: Filter replacement reminders, product care tips, installation support, and customer service communications.
(c) Promotional Messages: Special offers, discounts, promotional pricing, new product announcements, and exclusive deals.
(d) Educational Messages: Iowa water quality updates, educational content, event invitations, and community initiatives.
6.2 Consent and Opt-In
By providing your mobile phone number and checking the opt-in box on any of our forms, texting a keyword to our business number, or providing verbal or written consent at an event, you expressly consent to receive recurring SMS/text messages from Safe Water Iowa, LLC. Consent to receive text messages is not required as a condition of purchasing any product or service.
6.3 Opt-Out Instructions
You can cancel the SMS/text messaging service at any time. Simply text “STOP” to any message you receive from Safe Water Iowa. After sending STOP, you will receive a one-time confirmation message confirming that you have been unsubscribed. No additional text messages will be sent unless you re-opt in. You may also opt out by emailing [email protected] or contacting our customer support team.

6.5 Message and Data Rate Disclosure
Message and data rates may apply. Standard messaging and data rates from your mobile carrier apply to all text messages sent to and received from Safe Water Iowa. Check with your carrier for details about your messaging plan. Safe Water Iowa is not responsible for any charges imposed by your mobile carrier.
6.6 Message Frequency
Message frequency varies based on your interactions, purchases, and opt-in preferences. You may receive up to ten (10) messages per month. During promotional periods or after a purchase (for transactional updates), frequency may temporarily increase.
6.7 Carrier Liability Disclaimer
Safe Water Iowa, its affiliates, and mobile carriers (including but not limited to T-Mobile, AT&T, Verizon, U.S. Cellular, and all other carriers) are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your mobile carrier. Carriers are not responsible for the content of messages sent through their networks on behalf of Safe Water Iowa. Message delivery may be affected by network availability, device compatibility, carrier policies, and other factors outside our control.
6.8 Age Restriction
You must be at least eighteen (18) years of age to opt in to Safe Water Iowa’s SMS/text messaging program. By opting in, you represent and warrant that you are at least 18 years old. If we become aware that a person under 18 has opted in to our text messaging program, we will promptly remove their phone number and cease all text communications.
6.9 Privacy Policy
Your privacy is important to us. Please review our Privacy Policy at safewateriowa.com/privacy-policy for complete details on how we collect, use, and protect your personal information, including your mobile phone number and SMS/text messaging data. Our Privacy Policy is incorporated into these Terms by reference.
7. Warranty
7.1 Manufacturer’s Warranty
Our water filtration products may be covered by the original manufacturer’s warranty. The terms, duration, and coverage of any manufacturer’s warranty are determined solely by the manufacturer and are subject to their warranty policies. Safe Water Iowa will make reasonable efforts to assist customers in coordinating warranty claims with the manufacturer, but we are not the warrantor and do not independently guarantee the manufacturer’s warranty obligations.
7.2 Disclaimer of Warranties
EXCEPT FOR THE MANUFACTURER’S WARRANTY DESCRIBED ABOVE, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SAFE WATER IOWA EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR SPECIFIC REQUIREMENTS, THAT THEY WILL OPERATE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
8. Health and Regulatory Disclaimers
8.1 No Medical or Health Claims
SAFE WATER IOWA’S PRODUCTS ARE WATER FILTRATION DEVICES. THEY ARE NOT MEDICAL DEVICES AND HAVE NOT BEEN EVALUATED OR APPROVED BY THE U.S. FOOD AND DRUG ADMINISTRATION (FDA) FOR THE DIAGNOSIS, TREATMENT, CURE, OR PREVENTION OF ANY DISEASE OR HEALTH CONDITION. NOTHING ON OUR WEBSITE, IN OUR MARKETING MATERIALS, IN OUR SMS/TEXT MESSAGES, OR IN ANY COMMUNICATION FROM SAFE WATER IOWA SHOULD BE CONSTRUED AS MEDICAL ADVICE OR A HEALTH CLAIM.
Any references to contaminant removal rates (such as nitrate, lead, arsenic, or PFAS removal) are based on the product’s technical filtration specifications and/or testing certifications (such as NSF/ANSI standards) as reported by the manufacturer. These figures describe the mechanical capabilities of the filtration system and are not claims about health outcomes.
8.2 Water Quality Variability
Water quality varies significantly by location, source (municipal or private well), season, and other factors. While reverse osmosis technology is highly effective at reducing a wide range of contaminants, Safe Water Iowa does not guarantee that our products will reduce all contaminants to any specific level in your particular water supply. We strongly recommend that you test your water before and after installation to verify performance. Safe Water Iowa is not responsible for any health effects, property damage, or other consequences resulting from your water quality, your decision to use or not use a filtration system, or your reliance on any information provided by us.
8.3 Educational Content
Safe Water Iowa provides educational content, including our water quality guides, website content, SMS/text messages, and event materials, for informational purposes only. This content is not a substitute for professional water testing, plumbing consultation, or medical advice. While we make reasonable efforts to ensure accuracy and cite reputable sources, we do not guarantee the completeness or currentness of this information.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFE WATER IOWA, LLC, ITS OWNER(S), MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
(a) Your use of or inability to use our website, products, services, or SMS/text messaging program;
(b) Any product defect, malfunction, leak, failure, or improper installation;
(c) Any health effects, illness, injury, or death allegedly related to your water quality, our products, or our educational content;
(d) Property damage, including but not limited to water damage, caused by installation, use, or malfunction of our products;
(e) Any unauthorized access to, alteration of, or loss of your personal data;
(f) Any third-party conduct, products, or services, including installation services performed by third parties;
(g) Any delayed or undelivered SMS/text messages or email communications; or
(h) Any other matter relating to our website, products, services, or communications.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, OUR WEBSITE, OR OUR PRODUCTS EXCEED THE AMOUNT YOU ACTUALLY PAID TO SAFE WATER IOWA FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. This limitation applies regardless of the legal theory upon which your claim is based, whether in contract, tort (including negligence), strict liability, warranty, or otherwise, and even if Safe Water Iowa has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Safe Water Iowa, LLC, its owner(s), members, managers, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to: (a) your use of our website, products, or SMS/text messaging program; (b) your violation of these Terms; (c) your violation of any law, regulation, or third-party right; (d) any claim that your installation of a product caused property damage or personal injury; or (e) any dispute between you and a third-party installer, plumber, or other service provider.
11. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, photographs, product descriptions, guides, educational materials, and software, is the property of Safe Water Iowa, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, transmit, display, perform, or create derivative works from any content on our website without our prior written consent.
The Safe Water Iowa name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Safe Water Iowa, LLC. You may not use these marks without our prior written permission.
12. Website Use
12.1 Permitted Use
You may use our website for lawful purposes and in accordance with these Terms. You agree not to use our website in any way that could disable, overburden, damage, or impair the site, or interfere with any other party’s use of the site.
12.2 Prohibited Conduct
You agree not to: (a) use any robot, spider, scraper, or other automated means to access our website; (b) introduce any viruses, Trojan horses, worms, or other malicious code; (c) attempt to gain unauthorized access to any portion of our website, server, or connected systems; (d) use our website to transmit spam, chain letters, or other unsolicited communications; or (e) impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
12.3 Third-Party Links
Our website may contain links to third-party websites or services that are not owned or controlled by Safe Water Iowa. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party website. You acknowledge and agree that Safe Water Iowa is not responsible for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.
13. Charitable Donation Commitment
Safe Water Iowa donates five percent (5%) of net product sales to organizations supporting Iowa water quality initiatives. This commitment is made voluntarily and may be modified or discontinued at our discretion. The specific recipient organizations, timing of donations, and allocation of donated funds are determined solely by Safe Water Iowa. This donation commitment does not create any fiduciary duty, trust, or enforceable obligation to any customer, organization, or third party. The donation commitment is not a factor in the pricing of our products and does not constitute a warranty, guarantee, or contractual term of any purchase.
14. Dispute Resolution
14.1 Governing Law
These Terms and any dispute arising out of or relating to these Terms, our website, our products, or our SMS/text messaging program shall be governed by and construed in accordance with the laws of the State of Iowa, without giving effect to any principles of conflicts of law.
14.2 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for a period of at least thirty (30) days. Most concerns can be resolved quickly and to your satisfaction through direct communication.
14.3 Jurisdiction and Venue
Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Polk County, Iowa, and you consent to the personal jurisdiction and venue of such courts. You waive any objection to such jurisdiction or venue on the grounds of inconvenient forum or otherwise.
14.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST SAFE WATER IOWA, LLC.
14.5 Limitation on Time to File Claims
Any cause of action or claim you may have arising out of or relating to these Terms, our website, or our products must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy (available at safewateriowa.com/privacy-policy) and any specific promotional terms communicated at the time of purchase, constitute the entire agreement between you and Safe Water Iowa with respect to the subject matter hereof and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
15.2 Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
15.3 Waiver
No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Safe Water Iowa to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Safe Water Iowa may assign these Terms without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and assigns.
15.5 Force Majeure
Safe Water Iowa shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, supply chain disruptions, shipping delays, manufacturing delays, tariffs, trade restrictions, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
15.6 Notices
Any notices required or permitted under these Terms shall be in writing and shall be deemed given when: (a) delivered personally; (b) sent by email to [email protected] (for notices to Safe Water Iowa) or to the email address associated with your order (for notices to you); or (c) one (1) business day after being sent by nationally recognized overnight courier.
